i'm terry mcsweeney live at sequin where the state plans to execute a man early wednesday morning but not if his attorneys have anything to say about it. they'll be speaking this morning. we'll tell you what they're going to say and what their client didn't say over the weekend. >> in the headlines just hours from now, a bay area congresswoman will unveil new legislation that's meant to prevent the san bruno explosion from being repeated somewhere else. >> our heat wave peaks today even though where starting with a cool morning. how poor air quality's going to be today but also tomorrow. >> if you want to spare the air and take mass transit, so far things look good but it's fine right now with traffic across the bay bridge. >> i hope you had a great weekend. it's 4:30 on this monday morning.

thanks for joining us. i'm kristen sze. >> i'm eric thomas. another warm day across the bay area. with the high temperatures, pg&e is asking all bay area customers to conceive electricity after an equipment problem knocked out power saturday evening. they ask you to close windows and blinds before it gets very hot. you're being asked to turn off any unused lights and appliances and set your thermostat at 75 degrees or higher if you don't plan to be at home. >> all good ideas. mike joins us with more with expected heat and spare the air. >> the poor air quality continues to build along with the heat. good morning to you on this monday. we can't escape it in the east bay valleys and in the santa clara valley. that's where we'll find the poorest air quality. everybody else should be moderate and below the threshold of unhealthy levels. you can see the 1 hundreds fairfield concord livermore,

95 san jose, 89 oakland 87 san francisco today. monterey at 79 but 89 santa cruz and 100 degree temperatures morgan hill and gilroy. we'll talk about a slight cooling trend in the forecast coming up. here's kristen with more news. >> we'll be ready for it mike. the man who could become california's first inmate executed in five years will file an appeal this morning in marin county trying to derail his date with death set for wednesday. terry mcsweeney is live at san quentin. the man missed a deadline to make a choice over the weekend. >> he could have chosen the way he was going to be killed, a three-stage injection or one lethal injection. he didn't choose anything. the state is going to give him the three-stage injection maybe wednesday morning. the lawyers are going to be in marin county superior court this morning. he is scheduled to be put to death for the rape and murder of a 15-year-old girl in riverside

county back in 1980. four years ago the judge ruled the state three-stage lethal injection process was flawed and the prisoner could be paralyzed by the first shot but still able to feel the other two shots. >> the paralytic is the one that raised all kinds of concerns because if somebody was not sedated and was in excruciating pain you would see no visible signs of that. >> the judge also set up the time that the staff here at san quentin was poorly trained procedures were flawed. in the four years it's taken a look what it does out here, it's made major improvements. attorneys for the defendant -- not the defendant but the convicted killer i should say say they're not so sure about that. attorneys for brown are not only going to be in marin county superior today but also in front of the 9th circuit court of appeals trying to stay the execution trying to stop it. some experts say they have a

pretty good shot one way or the other in one court or another to stop it from happening early wednesday morning out here. terry mcsweeney, abc 7 news. >> terry, thank you very much. there's another issue for the state for future executions. california's attorney general's office says its limited supply of sodium pen ethanol expires october 1st and the primary company says it's out of stock probably until next year. that company, espira, sent a letter to state officials saying they provide these products because they improve or save lives. they say we do not support the use of any of our products in capital punishment procedures. >> jackie spear will unveil a plan to increase the federal government's role in overseeing natural pipeline safety. represents san bruno in washington and will announce her proposal near the steam of the tragic gas line explosion. that blast of course killed seven people and destroyed 35 homes.

it calls for requiring automatic or remote shutoff valves on some high pressure transmission lines. it will provide homeowners with more information where lines are located and how utilities plan to respond to negligence. federal records show pg&e's gas pipelines leak more than those belonging to other large utilities. according to the l.a. times, pg&e has more than six times the number of leaks than the national average. the number of leaks in urban areas has fallen by 30% nationally over the past few years while it has risen by 40% for pg&e's lines. pg&e has reported 38 leaks since 2004 along major lines that run through population centers or environmentally sensitive areas. the utility attributes the high numbers to adopting a more rigorous supporting standards last year. >> it's 4:35 now. this morning san francisco police are investigating a fatal shooting involving one of their own officers. it happened at a residential hotel at hutter and hyde.

police responded to a noise complaint at the grenada residential hotel 11:00 this the morning. they found someone throwing serio speakers out an apartment window. when they went to investigate the man turned on them. >> the man displayed weapons to the officer and the officer fired a fatal shot to the victim. >> authorities are not saying what kinds of weapon the man had. one resident says he heard as many as eight shots fired. meanwhile the san francisco s.w.a.t. team was ultimately needed to end a standoff involving hostages in an apartment on nearby franklin yesterday. detectives say that incident began with an altercation at a local starbucks yesterday morning. the man dropped his i.d. and police tracked him to an apartment building where he barricaded himself inside a neighbor's apartment. after ten hours of negotiating, police used tear gas and a police dog to end the standoff. nobody was hurt.

the suspect, 43-year-old timothy zike faces charges of burglary, vandalism and assault. >> a volunteer fired remains in critical but stable condition at a burn center in san francisco after battling a wildfire over the weekend. the firefighter was hurt while battling a fire that scorched 93 acres of eucalyptus groves. he touched a live power line. they reopened highway 1 near the scene last night after escorting drivers through the area for more than a day. >> 4:37. with the heat wave we know we have a few of the ingredients for high fire danger but do we have all of them. >> mike, do we have the total picture? >> we have a couple as you mentioned. the winds are the key. if anything does start it won't spread rapidly because of the wind. it's going to be very hot and dry again today. starting warm in some areas right now but still have another two hours of cooling ahead of us.

antioch fremont and los gatos in the 70s. mountain view san jose, concord in the 60s. everybody else the 50s under a clear sky. some of these temperatures are warmer than yesterday santa rosa novato, san francisco, oakland, concord fremont, mountain view and los gatos all about 2 to 5 degrees warmer but napa 6 degrees cooler than yesterday. nothing's cool this afternoon. half moon bay about 79 but even for them that's pretty warm. around mid to upper 80s for san francisco, richmond oakland san mateo. you can see the 90s until you get to the east bay valleys where it will be over 100 concord livermore fairfield. also around cloverdale and towards morgan hill. let's take a look at that accu-weather seven-day forecast. see if we can find you any relief. very warm tomorrow but the cooling will hit the coast and really accelerate on wednesday from the coast to inland on thursday -- or through the bay on thursday and finally by about the weekend it will hit our inland neighborhoods and the temperatures will be closer to average. it's going to be a very gradual

cooling after a very warm day today. and it's spare the air day. here's frances with more. >> the obvious alternate choice is mass transit if you want to help spare the air. but did you know if you reduce your speeds from 75 mph to 65 mph you increase gas mileage by 15%. so try to do that if you're heading out on the roads this morning. here's a live shot of 680 walnut creek. you certainly can go 75 mph around the bay area. also check out the san mateo bridge. no delays at all no accidents. not a lot of road work. but if you're heading out to the beach, 92 is jammed through the weekend and might happen later on this afternoon. eric, kristen. >> would you mind telling kristen what you said. >> that's for both of you. include california county for nearly 2100 guns connected to crimes in other states. the others listed are georgia, florida, virginia, texas, indiana ohio personal, north carolina and arizona. criminals and gun traffickers may favor states with more relaxed gun laws. >> the city of oakland has received three federal grants from the department of justice to help curb the violence in that city. the largest of the grants worth $2.2 million and aimed at juvenile crime to consider options outside the crimes on the street with a gang. worth $750,000 aimed at helping juveniles and adults who have been incarcerated get back to civilian society. >> many residents in a wisconsin town have evacuated their homes after a century-old levee started to fail. the wisconsin river flooded the only road in and out of one

undermining afghanistan's government. one afghanistan chief points out the idea is pressure the taliban in certain areas so they don't escape and turn up someplace else. the militants have fought back with rockets and gunfire. >> they crossed the border into neighboring iraq and killed 30 firefighters involved in last week's bombing of a military parade. 12 women and children died. a member of the guard told iranian state tv that the terrorists were killed in a clash beyond the border. iran had said it would target armed groups on iraqi soil but this is a rare case admitting to such an attack. a delegation will visit iran to try to secure the release of two americans held there for more than a year. this comes one week after iranians released u.c. berkeley graduate sarah shourd. iranian authorities captured sarah shane bauer and their friend josh fattal 14 months ago after they crossed into iran on a hiking trip in northern iraq.
